These terms and conditions apply to all transactions on this site. Please read them carefully. They do not affect your statutory rights.

These terms and conditions apply to the use of this website and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out here. If you do not agree to be bound by these terms and conditions you may not use or access this website.

Terms and Conditions

Audio Walk Downloads - Personal Licence

Acceptance of these terms and conditions will form a contract between you, the customer (“you”) and us Cities in Sound in relation to your use of the audio walk download files together with any associated materials provided (“the audio walk”).

Any use by you of the Cities in Sound website is subject to its Conditions of Use.

Downloading the Audio Walk

Once you have accepted these terms and conditions and your payment has been processed you will have ONE DAY in which to download the audio walk from your account. After this period has elapsed we regret that you will be unable to download the audio walk unless we agree otherwise.

We do not provide any assurance or warranty that our website will be uninterrupted or error free or that you will be able to access your account to download the audio walk at all times.

If you are unable to download the audio walk please contact our customer support centre by email on help@citiesinsound.com.

Ownership of Rights

The copyright and all other intellectual property rights in the audio walk and our website are owned exclusively by us or are licensed to us. You will not obtain any right, title or interest in these intellectual property rights by purchasing or using the audio walk or our website. You will have the right only to use the audio walk in accordance with the licence conditions set out below.

All trade marks, product names and company names or logos used on the audio walk or on our website are our property or that of their respective owners. No permission is given by us in respect of the use of any such trademarks, get-up, product names, company names, logos or titles and any such use may constitute an infringement of the holder’s rights.

Licence Terms

Upon payment in full of the price for the audio walk you will be permitted to:

Download one copy only of the audio walk file to a single computer which is under your control; transfer the audio walk from one computer to another, provided that the audio walk is used on only one computer at any one time; upload the audio walk to such number of MP3 players or audio devices as may be required for your exclusive personal use; burn the audio walk to such number of CDs or other audio storage media as may be required for your exclusive personal use.

The audio walk is strictly for your personal use and you may not provide or make copies for other people.

You are not permitted to sell, rent, lease, sub-licence or loan the whole or any part of the audio walk except as set out above (whether or not such acts are undertaken for commercial purposes).

You are not permitted to copy, modify, adapt, merge, translate, disassemble or create derivative works based on the whole or any part of the audio walk, or permit any of the above to be done, except as set out above (whether or not such acts are undertaken for commercial purposes).

Use of Audio Walks and our Liability

Any walks which you take (whether as a pedestrian or by any other means of transport) using the audio walk are undertaken at your own risk and Cities in Sound does not accept any responsibility for your personal safety, or for any loss or damage you may suffer, whilst using the audio walk. You are strongly advised to take all necessary precautions whilst undertaking a walk and to remain vigilant and aware of your surroundings at all times.

You are strongly advised to take out an appropriate travel insurance policy before undertaking an audio walk.

The audio walk is a standardised product and has not been adapted to your own particular requirements and we do not therefore provide any warranty or assurance that the audio walk will meet your particular requirements or be fit for the particular purpose for which you have purchased it, whether or not you have notified us of that purpose.

We shall have no liability to you for any defect or failure of the audio walk to the extent that it arises from any alteration made to the audio walk by you or any third party, any breach by you of these terms or use of the audio walk with incompatible software or hardware.

All information provided on the audio walk is to the best of our knowledge correct at the time of recording. However we do not provide any assurance that you will be able access all or any part of the route or any attractions or venues referred to in the audio walk nor do we accept any liability for any changes or events which occur after the recording of the audio walks.

All entrance fees and transport and other costs incurred in undertaking a tour using the audio walk are your responsibility.

We will not be liable to you for any loss or damage which you may suffer or incur which is indirect, consequential or unforeseen whether the loss arises as a result of our negligence or otherwise.

Our total liability to you for loss suffered by you in connection with the audio walk shall not exceed the purchase price of the audio walk.

Nothing in these terms limits or restricts our liability for fraud or for death or personal injury which arises as a direct result of our negligence.

Personal Information

You agree that we may collect, store and use information about you in accordance with our privacy policy. You agree to be bound by the terms of our privacy policy.

General

You may not transfer any of your rights under these Terms and Conditions to any other person.

These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the exclusive jurisdiction of the English courts.
